We have reviewed all the decisions of the Employment Relations Authority (ERA) between the dates of 31 October 2017 and 22 March 2018. These evidence a big increase in the awards in 2018.
We can show that following the decision of Waikato District Health Board v Archibald[2017] NZEmpC 132 (Archibald) there has been a significant uplift in the compensation awards.
In Archibald the Employment Court introduced the following bands of compensation:
- Band 1 involving low level loss/damage - nil to $10,000;
- Band 2 involving mid-range loss/damage - $10,000 to $50,000; and
- Band 3 involving high level loss/damage - $50,000 and over.
